A jovem contou que foi até a loja para comprar um secador de cabelo. Ao encontrar o produto, foi informada que teria que realizar um cadastro para realizar a compra. A cliente disse que, durante a coleta dos dados, a atendente do caixa a olhou com "uma expressão facial de estranheza" e que o vendedor "a olhava fixamente". Dois dias depois, percebeu que seu sobrenome foi substituído por "Carade Kenga" na nota fiscal. Disse que sentiu "humilhação, tristeza e baixa estima". A rede de lojas, em defesa, afirmou que não houve dano moral.
Ao analisar o processo, a magistrada observou que a empresa "confessou os fatos" ao informar que o funcionário responsável foi identificado e "retirado do quadro de colaboradores". Destacou que a atitude foi presenciada inclusive por outros funcionários, que tiveram contato com a nota fiscal no pagamento e entrega do produto.
Para ela, a substituição do nome, por si só, ofendeu a honra da jovem, "que, ao comprar um produto em uma loja, teve de suportar esse tipo de desrespeito, por funcionário que sequer já tinha visto". "A meu ver, emergiu clara a intenção do réu de ofender a autora por motivo, até então, desconhecido", disse a juíza. Ela também entendeu que os pais da adolescente, que alegaram "indignação", sofreram dano moral reflexivo, pois "presenciaram o sofrimento da filha".
A reparação foi fixada em R$ 5 mil à cliente, e R$ 1.500 a cada um de seus pais.
